Who we are
This privacy policy applies to kirktheobald.com.au, operated by Kirk Theobald, a property advisor working with My Property House (MPH), based in Adelaide, South Australia.
We are committed to protecting your personal information in accordance with the Australian Privacy Act 1988 and the Australian Privacy Principles (APPs).
What we collect
When you submit the enquiry form on this site, we may collect:
- Your name
- Mobile number
- Email address
- Suburb
- Property timeline (e.g. now, 6 months, exploring)
- Buyer type (e.g. first home, investment, upgrading)
- Finance status (e.g. pre-approved, not yet started)
- Property goal (e.g. owner-occupier, investment)
- Any notes you choose to enter in the free-text field
We do not collect payment information, government identifiers, or sensitive personal information as defined under the Privacy Act.
Cookies & tracking: This site does not use Google Analytics, Meta Pixel, or any third-party tracking scripts. The only cookie in use is a short-lived session token for our internal administration tool — it is never set for visitors to the public form.
Why we collect it
We collect your information for one primary purpose: to follow up with you about the free property conversation you requested. Specifically, we use it to:
- Contact you by phone, SMS, or email to arrange a chat
- Prioritise which leads to follow up with first, based on your stated timeline and goals
- Refer you to a licensed MPH agent if and when you are ready to transact, with your knowledge
- Improve how we reach people in your area through anonymous, aggregated source analysis (e.g. which QR code channel performs best)
We will not use your information for any purpose beyond what you reasonably expect from submitting a property enquiry form.
How it's stored
Your information is stored in a secure PostgreSQL database hosted by Supabase, located in the Sydney, Australia region. Access is protected by:
- Row-level security policies — only Kirk Theobald can read your record
- Encrypted connections (HTTPS/TLS) on all data in transit
- Password-protected administration access
We also receive an email notification when a new enquiry is submitted, sent via Web3Forms (a secure form-to-email service). This email contains the same information you submitted and is stored in a private email inbox.
We retain your information for as long as reasonably necessary to follow up, or until you ask us to delete it.
Who we share it with
Your information is not sold, rented, or shared with third parties for marketing purposes — ever.
The only circumstances in which we share your information are:
- MPH agents — only if and when you agree to be referred to a My Property House licensed real estate agent. You will be informed before any handoff occurs.
- Service providers — Supabase (database hosting) and Web3Forms (email delivery) process your data on our behalf under their own privacy policies and security standards. Neither sells your data.
- Legal requirements — if we are required by law to disclose information.
Your data never leaves Australia except where Supabase or Web3Forms infrastructure requires it for routine operations — both are GDPR-compliant and use industry-standard data protection practices.
Your rights
Under the Australian Privacy Act, you have the right to:
- Access the personal information we hold about you
- Correct any information that is inaccurate or out of date
- Delete your information from our records entirely
- Opt out of any further contact at any time
- Lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au if you believe your privacy has been breached
